# How to get your money back from Brazilian betting sites

> As of October 1, 2026, MP 1,394/2026 requires Brazil's formerly licensed betting sites to return bettors' money in full. You can withdraw your balance yourself until 11:59 p.m. on October 5, 2026; after that, each operator must send what it owes, listed by CPF, to its banks, which must pay it into an account in the bettor's name within 7 days, and money that can't be returned goes to an account at Caixa Econômica Federal.

## Key takeaways

- Deposits have been banned since September 25, 2026; under the government calendar, you can withdraw your balance until 11:59 p.m. on October 5, 2026.
- Bets still open at the shutdown deadline are void and must be refunded in full with no deductions; winnings on bets settled earlier must be paid (MP 1,394/2026, art. 7).
- Within 2 days of going offline, operators must send their banks and the SPA a per-CPF list of what they owe, or face a R$200,000 daily fine (art. 8).
- Banks then have 7 days to pay you into an active account in your name, preferably the one your money came from (art. 9).
- Money that can't be returned goes to an account at Caixa Econômica Federal, to be paid back to its owners under Ministry of Finance supervision.
- If you aren't refunded, contact the operator and your bank, then complain to the Ministry of Finance's ombudsman (Ouvidoria), consumidor.gov.br or your local Procon; courts are a last resort.

## Can you still get your money back?

Yes. As of October 1, 2026, Provisional Measure (Medida Provisória, MP) 1,394/2026 requires every formerly licensed betting operator in Brazil to return bettors' money in full. You can withdraw your balance yourself until 11:59 p.m. on October 5, 2026, under the government calendar; after that, operators and their banks must refund you automatically (arts. 7–9).

The MP banned sports betting and online casino games on September 25, 2026. Since then, offering bets has been illegal (art. 1) and no new deposits are allowed (art. 7), and banks and payment institutions may process betting transactions only to wind down operations and refund bettors (Resolution BCB 590/2026). For everything else the ban covers, read our [explainer on Brazil's 2026 betting ban](https://safebet.ai/br/guides/brazil-betting-ban/).

## Refund calendar

The dates below are the government calendar as reported by the federal news agency Agência Brasil on September 26, 2026; the rules behind each step are in the MP. As of October 1, 2026, we found no official refund FAQ on the government's gov.br websites, including those of the Ministry of Finance and its Secretariat of Prizes and Betting (Secretaria de Prêmios e Apostas, SPA), which keeps its supervisory powers over past facts (art. 5).

| Date (2026) | What happens | Legal basis |
|---|---|---|
| September 25 | Deposits banned | MP art. 7 |
| Until 11:59 p.m., October 5 | You can withdraw your balance yourself | Government calendar |
| October 6 | Sites and apps must be offline; unsettled bets are void | MP art. 7 |
| October 7–8 | Operators send each bettor's balance, identified by CPF (taxpayer number), to their banks and to the SPA | MP art. 8 |
| October 9–14 | Banks pay refunds into bettors' own accounts | MP art. 9 |
| From October 14 | Caixa Econômica Federal, the federal savings bank, receives money that couldn't be returned | MP art. 9 |

## Option 1: Withdraw before October 5

The quickest route is to withdraw your whole balance yourself while sites are still online, before 11:59 p.m. on October 5, 2026.

- **The money can only go to you.** Licensed sites could pay out only to a bank or payment account held in your name in Brazil (Law 14,790/2023, art. 30).
- **Allow time for identity checks.** SPA rules required licensed sites to verify your identity again, including with facial recognition, before withdrawals (Ordinance SPA/MF 1,231/2024, art. 36), so don't leave it to the last hour.
- **Save your records.** Before the site goes offline, save screenshots or statements of your balance, open bets and transaction history. You'll need them if a refund doesn't arrive, and for your tax records.

## Option 2: The automatic refund

If you don't withdraw in time, the MP makes the operator and its banks return your money.

1. **Open bets are canceled.** Bets not settled by the shutdown deadline are void, and your stake must be refunded in full, "with no deductions of any kind" (art. 7). Winnings on bets settled before the deadline must be paid.
2. **Operators report what they owe.** Within 2 days of going offline, each operator must secure enough money to pay everyone in full, send its banks a list with each bettor's CPF, the amount owed and the accounts the money came from, and send the same list to the SPA with proof of funds (art. 8). Bettors' money stays in segregated accounts in the meantime, and an operator that doesn't comply faces a fine of R$200,000 a day.
3. **Banks pay you.** Within 7 days of receiving the list, the banks must transfer the full amount to an active deposit or payment account held in your name and identified by your CPF, preferably the account your money came from, if it's still active and yours (art. 9).
4. **Leftovers go to Caixa.** Money that can't be returned goes to a dedicated account at Caixa "for restitution to the holders, under the supervision of the Ministry of Finance" (art. 9). The operator remains liable for any shortfall.

## What if you aren't refunded?

If nothing has reached your account once the bank refund window closes (October 14, 2026, under the reported calendar), work through these steps. The channels below were available as of October 1, 2026.

1. **Contact the operator.** Former operators must keep a legal representative and contact details registered with the SPA while their obligations last (art. 5).
2. **Ask your bank.** Banks can pay into any active account in your name, so check each one and ask whether a transfer from the operator's bank has arrived. The banks must report to the SPA what they did and didn't refund (art. 9).
3. **Check the Caixa stage.** From October 14, money that couldn't be returned goes to Caixa. As of October 1, 2026, we found no official guidance on how bettors will claim it.
4. **File a complaint.**
   - **The Ministry of Finance's ombudsman (Ouvidoria)**, which handles complaints about the SPA through the federal Fala.BR platform. The SPA, which receives the operators' refund lists, also lists a phone number on its website: (61) 3412-1920.
   - **Consumidor.gov.br**, the federal consumer-complaint platform, if the company is registered there. You need a gov.br account at silver or gold level; companies must reply within 10 days, and you then have 20 days to rate the answer.
   - **Your state or city consumer-protection agency (Procon).** The 2023 betting law gave bettors full rights under the Consumer Defense Code (Law 14,790/2023, art. 27), and the MP keeps that law applicable to the wind-down (art. 29).
5. **Go to court as a last resort**, for example a small-claims court (Juizado Especial Cível).

Keep screenshots, bank statements, dates and any replies as evidence.

## Watch out for refund scams

The MP requires refunds to be paid in full into an account in your name, so be wary of anyone who offers to speed up or "recover" a betting refund in exchange for a fee, your passwords or your bank details. Consumidor.gov.br warns that consumer-protection staff never contact consumers to ask for personal data.

Illegal betting promotions haven't stopped either. After the ban, a Ministry of Justice monitoring team found 1,900 betting ads on Google, some still promising bonuses such as "Ganhe R$ 50,00 grátis" ("Get R$50 free"), Agência Brasil reported on September 28, 2026. Any site that takes bets from people in Brazil after the ban is operating illegally (art. 1), and the MP's refund rules cover only formerly licensed operators.

## Taxes on your 2026 winnings

Until the ban, Brazil taxed annual net betting winnings at 15% on the amount above the first bracket of the annual income-tax table, which was R$28,467.20 for 2025 (Law 14,790/2023, art. 31; Federal Revenue Service, or Receita Federal). The MP revoked that article but keeps the 2023 law applicable to facts from the period when licenses were valid (art. 29). As of October 1, 2026, the Receita Federal had not published guidance on 2026 winnings after the ban, and it isn't confirmed whether operators will still issue their annual results statement (ComprovaBet) for 2026. Our guide to [betting taxes in Brazil](https://safebet.ai/br/guides/betting-taxes-brazil/) explains how the 15% rule works.

## The bottom line

As of October 1, 2026, the fastest way to get your money back from a Brazilian betting site is to withdraw it yourself before 11:59 p.m. on October 5, 2026. After that, the MP requires a full refund through the operator's bank into an account in your name, with Caixa holding anything that can't be returned.
