Taxes on betting winnings in Brazil (2026)
Under article 31 of Law 14,790/2023, net winnings from fixed-odds bets in Brazil were taxed at 15% under personal income tax (IRPF), on the year's positive results above the first bracket of the annual IRPF table (R$28,467.20 for 2025), with each type of bet netted separately and the tax calculated and paid by the bettor once a year. MP 1,394/2026 revoked article 31 on September 25, 2026, but keeps the old law applicable to facts that occurred while licenses were in force; as of October 1, 2026, no Receita Federal guidance for calendar-year 2026 had been found.
Key takeaways
- Law 14,790/2023 (art. 31) taxed net betting winnings at 15% under personal income tax (IRPF), only on the annual net result above the first IRPF bracket.
- Receita Federal nets each type of bet (sports, online games, fantasy sport) separately across all sites and adds up only the positive results, so a casino loss doesn't offset a sports profit.
- In Receita's example, R$62,000 of sports profit and a R$39,000 online-games loss meant R$5,029.92 in tax for 2025.
- For 2025 results, operators issued the ComprovaBet statement by the last business day of February 2026, and the tax was due by the last business day of April 2026.
- MP 1,394/2026 revoked art. 31 on September 25, 2026 but keeps the old law for facts that occurred while licenses were in force; Receita guidance for 2026 wasn't found as of October 1, 2026.
This guide explains Brazil’s rules as of October 1, 2026. No Receita Federal guidance for calendar-year 2026 had been found at that date, and Congress may still change the provisional measure that banned betting. It is general information, not tax or legal advice; an accountant (contador) can help with your own situation.
How were betting winnings taxed in Brazil?
Net winnings from fixed-odds bets were taxed at 15% under personal income tax (Imposto sobre a Renda das Pessoas Físicas, IRPF), but only on the part of your annual net result above the first bracket of the annual IRPF table. In English: net prizes from fixed-odds bets are taxed under IRPF at a 15% rate.
The details are in paragraphs of article 31 that were initially vetoed and later restored when Congress overrode the veto:
- the net prize (“prêmio líquido”) is the year’s positive result after deducting losses on bets of the same type;
- only net prizes above the first bracket of the annual IRPF table are taxed;
- the tax is calculated once a year.
The Federal Revenue Service (Receita Federal) treats these winnings as income subject to “tributação definitiva” (definitive taxation): you calculate and pay the tax yourself, and its guidance doesn’t describe operators withholding it. “Trata-se de um ganho tributável” (it’s a taxable gain), said Receita Federal’s José Carlos da Fonseca, as quoted by Agência Brasil in March 2026. The guidance covers fixed-odds bets under Law 14,790; no specific Receita guidance on winnings from unlicensed or offshore sites was found.
How Receita Federal calculates the tax
Receita Federal’s official Q&A for the 2026 income tax return (“Perguntas e Respostas IRPF 2026”, question 318) sets out the method for 2025 winnings:
- Net each type of bet separately, across all sites. For the whole year, work out gains minus losses for bets on real sports events, for online games (virtual events, such as casino games) and for fantasy sport.
- Keep only the positive results. Your net prize is the sum of the types that ended the year in profit. A loss in one type doesn’t offset a gain in another.
- Subtract the exempt amount. Only the net prize above the first bracket of the annual IRPF table is taxed. For calendar year 2025, Receita put that figure at R$28,467.20.
- Apply 15% to what’s left. That’s the tax due.
Worked example
Receita’s own example shows why the separate netting matters:
| Step | Amount |
|---|---|
| Net result on sports bets, all sites | +R$62,000 |
| Net result on online games, all sites | −R$39,000 |
| Net prize (positive results only) | R$62,000 |
| Minus the first IRPF bracket for 2025 | −R$28,467.20 |
| Taxable amount | R$33,532.80 |
| Tax at 15% | R$5,029.92 |
If the online-games loss could be offset against the sports profit, the net result would be R$23,000, below the exempt amount, and no tax would be due. Because it can’t, this bettor owed R$5,029.92.
The ComprovaBet statement
Operators had to give each bettor a “Comprovante de Resultados em Apostas em Loterias de Quota Fixa”, known as the ComprovaBet, by the last business day of February. It shows your betting results for the previous year. Because the netting covers every site you used, you need the statement from each one.
For 2026, it isn’t clear whether operators will issue a ComprovaBet. Licensed sites must go offline from October 6, 2026, and their authorizations end 30 days after the MP’s publication, although the MP keeps their tax and reporting duties alive and requires them to keep records for at least five years (arts. 10–11). No official guidance on 2026 statements had been found as of October 1, 2026, so keep your own records of deposits, withdrawals, winnings, losses and any refund you receive.
Filing and payment deadlines
For 2025 results, Receita Federal’s guidance sets this calendar:
| Step | What happens | Deadline for 2025 results |
|---|---|---|
| Statement | Each operator issues your ComprovaBet | Last business day of February 2026 |
| Calculation | You apply 15% to the net prize above R$28,467.20 | March 2026 |
| Payment | You pay with a DARF (federal tax payment slip) generated in Receita’s app | Last business day of April 2026 |
| Annual return | Net prizes go under code 13 of “Rendimentos Sujeitos à Tributação Exclusiva/Definitiva”; balances held on betting platforms go under “Bens e Direitos” | In the 2026 IRPF return |
In English, the return sections are “income subject to exclusive or definitive taxation” and “assets and rights”. According to Agência Brasil’s March 2026 report on Receita’s rules, people who received more than R$28,467.20 in fixed-odds betting prizes during 2025 had to declare them, and balances above R$5,000 held on betting platforms on December 31, 2025 had to be listed under “Bens e Direitos”.
Receita Federal provides an online application for paying tax on fixed-odds bets and fantasy sport that generates the DARF. If you owed tax on 2025 winnings and missed the April deadline, talk to an accountant or Receita Federal about putting it right.
What changes with MP 1,394/2026
Provisional Measure (Medida Provisória, MP) 1,394/2026, in force since September 25, 2026, bans fixed-odds betting and, in its article 29, revokes most of Law 14,790/2023, including article 31. The same article keeps the old law applicable “aos fatos ocorridos durante a vigência das autorizações”, meaning to facts that occurred while operators’ authorizations were in force, and to the wind-down obligations.
One reading of that clause, which this guide follows, is that winnings from licensed betting between January and September 2026 are still taxed under the article 31 rules, and would be declared in 2027: same 15% rate, same separate netting, same annual calculation. That is a reading, not official guidance. As of October 1, 2026:
- no Receita Federal guidance on calendar-year 2026 had been found;
- the exempt amount for 2026 (the first bracket of the 2026 annual IRPF table) wasn’t confirmed for this guide;
- Congress can still amend the MP when it votes on it (the deadline is November 23, 2026, extendable once by 60 days), and requests to suspend it are pending at the Supreme Federal Court (STF).
The MP also sets out how account balances are returned to bettors; see how to get your money back from betting sites. Receita hasn’t said how refunds fit in. One reading is that a refunded balance is a return of your own money rather than a new prize, but that isn’t confirmed.
Fantasy sport
Receita Federal’s guidance treats fantasy sport prizes like fixed-odds winnings: they’re subject to definitive taxation at 15%, as their own category in the separate netting described above. Article 49 of Law 14,790, which says fantasy sport isn’t a lottery or fixed-odds bet and needs no authorization, is not among the provisions the MP revoked.
But Receita based the tax treatment of fantasy sport on article 31, which the MP did revoke. No guidance on how fantasy prizes will be taxed after the MP had been found as of October 1, 2026.
Records to keep
Whatever Receita decides for 2026, these records will help you, or your accountant, get it right:
- every ComprovaBet or results statement you received;
- deposit and withdrawal receipts, such as Pix and TED confirmations;
- records of any balance refunded under the MP;
- DARF payment receipts for past years.
The bottom line
Under Law 14,790/2023, Brazil taxed net betting winnings at 15% on the year’s positive results above the first IRPF bracket, with each type of bet netted separately: R$5,029.92 in Receita’s example of R$62,000 in sports profit and a R$39,000 online-games loss. MP 1,394/2026 revoked that rule but keeps the old law for past facts, and no Receita Federal guidance for 2026 had been found as of October 1, 2026, so keep your records and check with an accountant before you file. Frequently asked questions
Do I have to pay tax on betting winnings in Brazil?
Under Law 14,790/2023, yes, if your net annual result exceeded the first bracket of the annual IRPF table: the excess was taxed at 15%. For 2025, the exempt amount was R$28,467.20, and the tax was due by the last business day of April 2026.
Can I offset casino losses against sports betting winnings?
No. Receita Federal calculates a separate net result for each type of bet (sports, online games and fantasy sport) and adds up only the positive ones, so a loss in one type doesn't reduce the tax on a gain in another.
What is the ComprovaBet?
It's the statement of your betting results (Comprovante de Resultados em Apostas em Loterias de Quota Fixa) that licensed operators had to provide by the last business day of February for the previous year. Keep it with your tax records.
Does the 2026 betting ban change the tax on my winnings?
MP 1,394/2026 revoked the tax rule on September 25, 2026 but keeps the old law applicable to facts that occurred while licenses were in force, which suggests winnings from licensed betting earlier in 2026 are still taxed the old way. As of October 1, 2026, no Receita Federal guidance confirming this had been found, and the 2026 exempt amount wasn't confirmed. For balances being returned, see how to get your money back from betting sites.
Are fantasy sport prizes taxed?
Yes, under Receita Federal's guidance for 2025: fantasy sport is its own type of bet in the separate netting, taxed at the same 15%. Guidance on fantasy prizes after the MP revoked article 31 hadn't been found as of October 1, 2026.
